Posted on Jul 06, 2023

Are you holding back on your dream of starting an arts and crafts club because the thought of dealing with all the legal aspects scares you?

Don't let fear stop you from pursuing your passion!

Getting your legal ducks in a row may initially appear overwhelming.

But, with a little guidance and the right mindset, the process can be manageable… and even exciting (yes, really!)

US based lawyer Kiffanie Stahle from The Artist’s J.D is our in-house ‘legal eagle’ and she assists our CCC members with translating legalese into the language of creative people.

Kiff firmly believes that there should be ease in the legalese of running a creative business and we cannot agree more!

In this blog (and in Kiff’s awesome free quiz), she’ll guide you through the necessary steps to navigate the legal requirements for your club, whether you're teaching online, in person, or selling creative kits.

**Remember, each jurisdiction may have specific requirements and procedures. This blog is merely a guide; it's crucial to conduct thorough research and consult with local authorities or legal professionals to ensure you adhere to the applicable laws and regulations in your area.

Let's dive in and let Kiff set the stage for your legal success!

Step 1: Select and Register Your Club Name

Choose a Name:

  • Choose a name that reflects your vision and captures the imagination.

Check Availability:

  • Start by visiting the official website of your local government or business registration office.
  • Look for information on business name registration.
  • Do an internet search and also use the government website to do a thorough search to ensure it's not already in use by another business in your industry or location.

Register Your Business Name:

  • Once you have confirmed the availability of your chosen name, it's time to make it official by registering your business.
  • Follow the registration process on the official website of your local government or business registration office.
  • This usually involves submitting an application, providing necessary documentation, and paying any associated fees.

Top Tip: As you accomplish each task, you'll gain confidence and momentum. Celebrate small victories along the way!

 Step 2: Consider Insurance

Wrap your creative haven in a protective bubble of insurance coverage.

Explore options for general liability to keep your club shielded from any unforeseen accidents or mishaps.

Speak with your insurance agent to understand the specific coverage options available for your business.

Step 3: Obtain Licenses and Permits

Depending on your location and the nature of your arts and crafts club, you may need to obtain specific licenses and permits to operate legally.

  • Research the requirements related to your industry

such as childcare licenses, health department approvals, or permits for selling craft kits. Contact the relevant authorities or consult with a business attorney to ensure you comply with all necessary regulations.

  • Consider Sales / USE Tax

If you sell physical kits or subscriptions, then you might have to get a seller's permit or a sales tax certificate.

  • Leverage the CCC community

Connecting with other creatives in your area can be an invaluable resource when it comes to obtaining licenses and permits for your arts and crafts club.

Note: If you are operating online-only this doesn't give you an out. Make sure you comply by following the steps listed above.

Step 4: Craft a Consent and Liability Form

Protect yourself and your students by developing a consent and liability waiver.

Your form should:

  • Clearly outline any potential risks,
  • Release you from liability, and
  • Have a checkbox to secure permission for activities like photography.

Ensure students, parents or guardians sign these forms before they or their children participate.

Step 5: Establish a Contract and Usage Policy

When offering classes or selling kits, establish a clear contract and terms of service agreement.

These documents should outline payment terms, refund policies, intellectual property rights, and any other relevant terms and conditions.

These don't have to be long, complex, or stuffed with legal jargon to be valid. In fact, by making them simple to understand, you'll make it easier for everyone.

Top Tip: Customize Legal Templates

Rather than starting from scratch, take advantage of existing legal templates.

Kiff offers customizable agreements, consent forms, and policies tailored to arts and crafts businesses.

Modify them to suit your specific needs, ensuring they cover essential legal aspects.

 Step 6: Seek Professional Guidance

By seeking professional guidance, you'll receive expert advice and support tailored to your unique situation.

A professional can help simplify the process and provide you with the necessary steps to get your arts and crafts club legally sound.

Here are two avenues to explore:

  • Kiff's Quiz:

If you're based in the US, take the 2-minute quiz provided by Kiff.

This quiz can provide tailored guidance and resources specific to your business, helping you understand the necessary legal steps.

  • Small Business Development Centers (SBDCs) or Administration Offices:

Locate and visit your nearest SBDC or Administration Office. Set up a meeting with a representative who can assist you in understanding the specific legal obligations for your arts and crafts club. They will provide a checklist of tasks you need to complete to ensure your business is legal and legitimate. Easy peasy.

Making your business legal and legitimate doesn't have to be a daunting task. With the right support and guidance, the process can be straightforward and manageable.
